These terms set out the basis on which Phinaikam Law provides inheritance legal services to clients. We encourage you to read them at your own pace. If anything is unclear, please contact us before proceeding.

01 Definitions

Throughout these Terms and Conditions, the following words carry the meanings set out below:

"We / Us / Our"
Refers to Phinaikam Law, a legal services firm registered in Chiang Mai, Thailand, located at 77 Charoenrat Road, Wat Ket, Chiang Mai 50000.
"Client / You"
Any individual or organisation that accesses this website or engages Phinaikam Law for legal services.
"Services"
Inheritance legal services offered by Phinaikam Law, including Estate Clarity Review, Succession Liaison Support, and Contested Matter Representation.
"Website"
The website accessible at phinaikamlaw.live and any associated pages.
"Agreement"
These Terms and Conditions together with our Privacy Policy and any service agreement entered into with a client.
"Content"
All text, documents, images, and materials published on this website.

02 Acceptance of Terms

By visiting this website, submitting an enquiry form, or engaging Phinaikam Law for legal services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms.

If you do not agree with any part of these terms, please do not use this website or engage our services. You are welcome to contact us with questions before proceeding.

03 Service Description

Phinaikam Law provides inheritance and estate legal services to families and individuals navigating succession matters in Thailand. Our current service offerings are:

Estate Clarity Review — ฿1,520

A careful review of an estate with a written summary, helping families understand their position before making any decisions. Includes a private consultation and plain overview.

Succession Liaison Support — ฿2,770

Patient liaison with relevant offices and handling of succession documents. Timelines depend on third parties. Includes regular updates.

Contested Matter Representation — ฿4,150

Respectful representation in contested estate matters, with thorough preparation and full document handling. Each matter is assessed on its own facts first.

Services are primarily offered within Thailand and subject to Thai law. We reserve the right to decline any engagement where a conflict of interest exists or where the matter falls outside our areas of practice.

04 Client Responsibilities

When using this website or engaging our services, clients agree to:

  • Provide accurate, complete, and current information when submitting enquiries or entering service agreements.
  • Promptly inform us of any changes to information provided.
  • Cooperate reasonably in the handling of their matter, including providing requested documents in a timely manner.
  • Use this website only for lawful purposes and in a manner that does not infringe the rights of others.
  • Not attempt to disrupt or compromise the security of this website or its underlying systems.
  • Not reproduce or distribute content from this website without prior written consent.

05 Intellectual Property

All content on this website — including text, layout, design, and associated materials — is the property of Phinaikam Law or its content suppliers and is protected under applicable Thai and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to access and view this website for personal, non-commercial purposes only. This licence does not include the right to reproduce, modify, distribute, or publicly display any material from this website without our written consent.

Documents, summaries, and written materials prepared specifically for a client as part of a service engagement remain the property of Phinaikam Law until full payment has been received, at which point ownership transfers to the client as agreed in writing.

06 Payment Terms

Fees for services are as set out in the service descriptions on this website, quoted in Thai Baht (฿). Prices are subject to change without notice, though any fee agreed in a written service agreement will remain fixed for the duration of that engagement.

Payment terms will be confirmed in writing at the commencement of each engagement. Where a deposit is requested, work will ordinarily begin once the deposit has been received.

Accepted payment methods will be communicated during onboarding. All payments are to be made in Thai Baht unless otherwise agreed in writing.

Refund requests are considered on a case-by-case basis. Where work has commenced, a partial refund may be offered at our discretion reflecting the proportion of work not yet undertaken. We will always aim to reach a fair and considerate resolution.

07 Service-Specific Terms

Scope and Changes

The scope of each service engagement will be confirmed in writing before commencement. Any material change to the scope requested by the client may result in revised fees, which will be communicated in advance.

Timelines

Estimated timelines are provided in good faith. Where a matter involves third parties — such as government offices, courts, or external registries — timelines are subject to those parties' processes and cannot always be determined precisely in advance.

Confidentiality

We treat all client information as strictly confidential. Information shared with us in connection with your matter will not be disclosed to third parties except as required by law, with your consent, or as necessary to carry out the service engaged.

Document Handling

Original documents provided to us will be handled with care. Where copies are taken, originals will be returned as agreed. We accept no liability for documents not in our direct custody.

08 Disclaimers

The information on this website is provided for general reference purposes only and does not constitute legal advice. Reading or relying on content from this website does not create a solicitor–client relationship.

Legal outcomes depend on the individual facts of each matter and cannot be predicted or committed to in advance. Nothing on this website should be understood as a representation regarding any particular result.

09 Limitation of Liability

To the fullest extent permitted by applicable Thai law, Phinaikam Law shall not be liable for any indirect, consequential, or incidental losses arising out of your use of this website or engagement of our services.

Where liability cannot be excluded by law, our total liability shall not exceed the fees paid by the client for the specific service engagement to which the claim relates.

We are not liable for delays or failures caused by circumstances outside our reasonable control, including acts of third-party offices, courts, or administrative bodies.

10 Indemnification

You agree to indemnify and hold harmless Phinaikam Law, its principals, and staff from and against any claims, losses, or expenses (including reasonable legal costs) arising from:

  • Your breach of these Terms and Conditions.
  • Your provision of inaccurate or incomplete information in connection with your matter.
  • Your infringement of the rights of any third party.

11 Termination

Either party may bring an engagement to a close by providing reasonable written notice. Where a client wishes to discontinue, we will confirm the position in writing and arrange for any documents to be returned.

We may decline to continue an engagement where a conflict of interest arises, where the matter falls outside our competence, or where the conduct of the client makes continuation unreasonable. In such cases, we will provide as much notice as the circumstances reasonably allow.

Fees for work completed to the point of termination remain payable. Clauses relating to confidentiality, intellectual property, limitation of liability, and dispute resolution survive the end of any engagement.

12 Dispute Resolution

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising from or connected to these terms shall be subject to the jurisdiction of the Thai courts, with the courts of Chiang Mai Province having primary jurisdiction where applicable.

Where a dispute arises, we encourage both parties to first seek resolution through direct and good-faith communication. Most concerns can be addressed promptly through a frank conversation. Please contact us at [email protected] with any concern.

If direct resolution is not achieved, the parties may consider formal mediation before resorting to litigation, though this does not form a mandatory step unless agreed in writing.

13 General Provisions

Entire Agreement. These Terms and Conditions, together with any written service agreement, constitute the entire agreement between Phinaikam Law and the client in respect of the matters covered.

Severability. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full effect.

Waiver. Failure by either party to enforce any provision shall not be construed as a waiver of the right to do so in the future.

Assignment. You may not transfer or assign your rights or obligations under these terms without our prior written consent. We may assign our obligations with reasonable notice to you.

Notices. Formal notices should be sent in writing to the address below, or via email to [email protected].

14 Changes to Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or operational practice. When we do, we will update the "Last Updated" date at the top of this page.

Continued use of this website or our services after any update constitutes your acceptance of the revised terms. We recommend revisiting this page periodically. If a change materially affects an ongoing engagement, we will inform you directly.
